FMLA Certification Must Be Provided to Employer

Friday, March 4, 2005

The Fifth Circuit Court of Appeals has held that because an employee failed to provide an employer-requested medical certification form required to approve her FMLA leave request, the request was nonqualifying. Therefore, the Court concluded, the employee's absence for her carpal tunnel surgery was unauthorized and she was properly terminated.

The Fifth Circuit found that the failure to provide the certification did not fall within the right of employees to cure problems in certification forms as allowed by the regulations.
